Dispute Resolution by Binding Individual Arbitration
Any dispute between you and TekChoice Electronics or any of its agents must be resolved through individual arbitration, with the exception of the following circumstances:
Any dispute falling within the jurisdictional scope and amount of an appropriate small claims court must be brought in small claims court on an individual basis.
Any dispute to seek to enjoin infringement or other misuse of intellectual property rights may be brought in any court of competent jurisdiction.
Any disagreement or conflict arising from, or in connection with, your association or communication with TekChoice Electronics, its representatives, and its current and future affiliated companies, partners, and assignees, shall be considered as a dispute and will be construed in the broadest sense.
Covered claims may arise from a variety of legal theories such as contract, tort, statute, fraud, misrepresentation, or other applicable legal principles. Some examples of relationships or interactions that could lead to a covered claim include, but are not limited to:
Your utilization of TekChoice Electronics websites;
Your participation in any TekChoice Electronics loyalty or rewards program.
Receipt of delivery, repair, installation services, or consultation services provided by TekChoice Electronics or its agents.
Communications between you and TekChoice Electronics.
Application for financing.
Purchase of Products offered, sold, or distributed by TekChoice Electronics, including any Dispute arising from advertising or sales practices related to such Products.
For TekChoice Electronics customers, Dispute also includes disputes that occurred before enrollment in, or after cancellation or termination of, the TekChoice Electronics program, including claims subject to purported class action litigation.
By agreeing to arbitration, you acknowledge and agree that you are relinquishing your ability to pursue alternate dispute resolution methods, like court proceedings or administrative hearings. The arbitration process operates under distinct rules, lacking a traditional judicial setting with a judge or jury, offering limited discovery, and having restricted appellate review. Arbitrators possess the authority to grant damages and relief comparable to those available in a court of law.
Before either Party can commence an arbitration proceeding, both you and TekChoice Electronics commit to attempting to resolve the Dispute informally in good faith for a period of 60 days, unless mutually extended. If you plan to proceed with arbitration, you must first provide TekChoice Electronics with a fully completed notice of your Dispute (the “Notice”). This Notice must contain your name and contact details (including address, phone number, and email address), as well as information necessary for TekChoice Electronics to identify any relevant transaction. The Notice must also contain a detailed description of (1) your Dispute; (2) the specific facts supporting your claim(s); (3) the nature and basis of the damages you claim to have suffered; and (4) a calculation and explanation of the relief sought. Your Notice must be personally signed by you and sent to TekChoice Electronics LLC at 1971 E. Beltline Ave NE STE 750 Grand Rapids MI, 49525 or by email at Arbitration@TekChoiceElectronics.com. If TekChoice Electronics decides to commence an arbitration proceeding, it will send a Notice to you at the contact information we have on file. If requested by TekChoice Electronics as part of this necessary informal dispute resolution process, you consent to personally participate (along with your counsel, if you are represented) in a telephone conference to discuss the potential resolution of the Dispute between you and TekChoice Electronics. If the dispute remains unresolved after 60 days following receipt of the Notice (or an extended period agreed upon by both parties), either you or TekChoice Electronics may initiate individual arbitration. This step is a prerequisite to proceeding with any formal dispute resolution. Should there be any concerns regarding the adequacy of a Notice or adherence to the mandatory informal dispute resolution process, a court may be called upon by either party. In such cases, any formal dispute resolution proceedings will be put on hold until the matter is resolved. The court has the authority to uphold this prerequisite, including the ability to prevent the filing or pursuit of arbitration. The statute of limitations and any deadlines for filing fees will be paused while the Parties engage in this informal process.
If the Parties cannot resolve the Dispute through the mandatory informal dispute resolution process mentioned earlier, either Party has the option to begin an arbitration proceeding by submitting a demand to the American Arbitration Association (AAA) detailing the nature and basis of the claim, along with all necessary information outlined in the Notice. The Party initiating arbitration must also provide a personally signed certification confirming compliance with the informal dispute resolution process.
To notify us of a demand, please serve a copy on our registered agent TekChoice Electronics LLC at 11971 E. Beltline Ave NE STE 750 Grand Rapids MI, 49525. The arbitration will follow the AAA’s relevant Consumer Arbitration Rules or Commercial Arbitration Rules (referred to as the “AAA Rules”), along with modifications outlined in these Terms, and will be overseen by the AAA. The AAA Rules and instructions for submitting an arbitration claim can be found at www.adr.org. In the event that the AAA is unable or unwilling to manage the arbitration in accordance with this Dispute Resolution section, a different arbitration provider will be selected by the Parties to administer the arbitration in line with it. If the Parties cannot reach an agreement on a provider, a court will choose one to oversee the arbitration as outlined in this Dispute Resolution section.
The parties shall bear their own attorney's fees and costs in arbitration, unless authorized by law or determined by the arbitrator to be frivolous, brought for an improper purpose, or in bad faith (according to Federal Rule of Civil Procedure 11(b) standards). The arbitrator will follow the guidelines of Federal Rule of Civil Procedure 68 after issuing the award.
The arbitration may be conducted by telephone, virtually, through written submissions, or in person at a mutually agreed upon location or in the county where you reside. TekChoice Electronics retains the right to request a hearing from the arbitrator. You agree to personally attend any in-person hearing (along with your legal representation if applicable).
Both you and TekChoice Electronics AGREE that any claims brought against each other must be done so in your or its individual capacity, and not as a plaintiff or class member in any supposed class, consolidated, private attorney general, or representative proceeding. This implies that you cannot claim to represent a class or any other individual. The arbitrator may only award declaratory or injunctive relief to the individual party seeking relief, and only to the extent necessary to provide relief for that party's individual claim. The arbitrator may not provide relief for or against any individual who is not a party to the arbitration proceeding. Additionally, in the event that both you and TekChoice Electronics do not reach a different agreement, the arbitrator is not permitted to combine the claims of multiple individuals or oversee any type of collective or class action. Should a court determine that a claim for public injunctive relief cannot be waived and all appeals have been exhausted, the Parties agree to temporarily postpone any public injunctive relief claims until the completion of arbitration for remaining issues. If this particular clause is deemed unenforceable, the entire dispute resolution provision (excluding the waiver of a jury trial) will be rendered invalid.
The following procedures pertain to mass arbitrations involving twenty-five (25) or more similar claims against TekChoice Electronics. In the event that multiple claims are filed by the same or coordinated counsel, or are otherwise coordinated, you acknowledge and accept the application of these additional procedures, which may result in a delay in the resolution of your Dispute. Both the counsel for claimants and TekChoice Electronics will each choose fifteen (15) cases (per side) to proceed with individual arbitration proceedings as part of a bellwether process. Each of these thirty (30) cases will be assigned to a different arbitrator.
The additional cases will not be submitted for arbitration or considered as filed until they are chosen to move forward in individual arbitration proceedings during the bellwether process. If the Parties are unable to resolve the additional cases following the initial thirty proceedings and good-faith discussions, each side will select another fifteen cases to undergo individual arbitration in a second bellwether process. Each of these new thirty cases will be assigned to a different arbitrator. The cases not yet filed for arbitration will not incur any AAA fees until they are selected to proceed in the bellwether process. Each case will be overseen by a single arbitrator.
Each arbitrator may only be assigned one case as part of the bellwether process, unless the Parties agree otherwise. No identical sets of arbitrators will be assigned to sets of bellwether proceedings. This sequential process will involve thirty (30) cases in each set of bellwether proceedings, following the specified parameters mentioned above. The remaining cases will not be filed or considered filed in arbitration, and no AAA fees will be imposed until they are chosen to move forward. This process will continue until all claims in the coordinated filings, including your case, are resolved through adjudication, settlement, or other means.
The statute of limitations and filing fee deadlines will be paused for claims undergoing mass arbitrations, starting from the selection of the initial cases for a bellwether process until your case is chosen, withdrawn, or resolved. Both you and TekChoice Electronics agree to participate in this process in good faith. A court has the authority to uphold this provision and, if necessary, to prevent the mass filing or prosecution of arbitration demands against TekChoice Electronics.
In the event that a claim proceeds in court instead of arbitration, both parties waive the right to a jury trial unless such a waiver is deemed unenforceable. This means that any claim will be decided by a judge, not a jury.
The Federal Arbitration Act will govern this provision for resolving disputes. It will remain in effect even if membership programs or subscription services are terminated or cancelled, or if your relationship with TekChoice Electronics ends. Any changes to this provision will not impact ongoing arbitration proceedings.
Jurisdictional Law
These terms will be governed by the Federal Arbitration Act and applicable federal law. In the absence of federal law, the laws of the state of Michigan will apply. Regardless, principles of conflict of laws will not be considered in determining the jurisdictional law. These laws will govern any disputes against TekChoice Electronics.
Use Termination
We reserve the right to terminate your account or access to TekChoice Electronics Properties at our discretion. You are responsible for any orders or charges made before termination. We may modify, suspend, or end any part of TekChoice Electronics Properties without prior notice.
Terms of Use for TekChoice Electronics Properties
The TekChoice Electronics Properties are intended for personal, noncommercial use only. Individuals under the age of 13 are prohibited from using any TekChoice Electronics Property. If you are between the ages of 13 and 18, you must have the involvement of a parent or guardian to use the TekChoice Electronics Properties.
What is Price Match+
Our Price Match+ program guarantees that we will match the prices of major retailers on a specific item. Not only that, but we will also discount the matched price by an additional $1, ensuring that our price is unbeatable.
Terms and Exclusions of Price Match+
This offer is valid for the advertised online price of identical items sold by TekChoice Electronics and major retailers. When comparing prices, the total advertised price of the item, including shipping costs, will be considered as the Price. However, Price will not include discounts from a "Loyalty" or "Membership" program, nor shipping discounts from a membership program like Amazon Prime. Sales tax will not be included in the Price Match of a TekChoice Electronics item.
Both TekChoice Electronics and the major retailer's Price must be advertised when requesting a price match. The Price Match+ is applicable only for purchases made within the United States.
The Price Match+ does not apply to:
Auction site prices.
Items without the Price Match+ Link at the time of purchase.
TekChoice Electronics or major retailer items offered for free, with a rebate, coupon, promotional gift card/credit, as part of a bundle or financing offer, as part of a clearance/closeout sale, or for sale for less than 6 hours in a day.
Out of stock items or items with limited quantities from TekChoice Electronics or major retailers.
Major retailer items advertised below TekChoice Electronics' actual cost.
Open box or refurbished items from TekChoice Electronics or major retailers.
Additional services like extended warranties or installations.
Items subject to MAP pricing from TekChoice Electronics or major retailers.
Price errors in TekChoice Electronics or major retailers' advertisements.

All products purchased and shipped by TekChoice Electronics are entitled to complimentary returns within a 14-day period, with free return shipping included.
Return Shipping Labels
At TekChoice Electronics, return shipping labels are provided free of charge for products weighing up to 50lbs. Customers can request a prepaid return label as part of the return process within the specified return policy period.

Refunds Process
After your return is processed, refunds will be issued to the original payment method. If the original payment method is unavailable, a check will be mailed to the billing address on file. For gifts, refunds will be provided in the form of e-store credit.
If an egift card from TekChoice Electronics was applied to a purchase that is later refunded, the refund will be credited back to the same egift card. The refund amount will equal the value deducted from the egift card for the initial purchase. Any excess amount not covered by the egift card will be reimbursed to the original payment method.
eStore Credit Process
For returns in exchange for store credit, TekChoice Electronics will provide you with eStore Credit in the form of a TekChoice Electronics eStore Credit eGift Card. Upon completion of the return process, a TekChoice Electronics eStore Credit eGift Card will be generated and delivered to you via email within an estimated timeframe of 1-2 business days. Exchange Process
Once your return has been processed, an exchange will be processed and shipped within approximately 1-2 business days. If TekChoice Electronics no longer carries a product that is sent in for replacement, or if that product is out of stock, a refund will be issued instead.
Products eligible for an exchange may only be replaced with the same product. Exchanges or returns for replacements with different products are not allowed at this time.
Return Policy for Specific Products
Bundle Purchases
Bundles consist of multiple products offered at a reduced price. To receive a refund, the entire bundle must be returned. Individual products can be returned for a replacement.
Combo and Kit Purchases
Combos and Kits consist of two or more products that must be bought together to qualify for a discount. Each product within a Combo or Kit can be returned individually for replacement under TekChoice Electronics' Return Policy.
When returning a single item from a Combo or Kit for a refund, any discount applied will be subtracted from the refund amount. If the discount on the Combo/Kit is greater than the price of the individual product, all items in the Combo/Kit must be returned or exchanged with other items of equal value to receive a refund. Return Policy for Software, Media, and Video Games
Items that have been opened or activated, such as physical copies of software, software licenses, movies, music, books, video game consoles, VR consoles, and video games, cannot be returned, exchanged, replaced, or refunded.
However, unopened or unactivated physical copies of software, software licenses, movies, music, books, video game consoles, VR consoles, and video games may potentially be eligible for replacement, contingent upon adherence to specified terms and conditions.
Consumable Products Policy
Consumable products that have been opened or activated are not eligible for return, exchange, replacement, or refund. Refund Policy for Digital Products

Manufacturer Promotional Products and TekChoice Electronics eGifts
Manufacturers sometimes provide free promotional products with their items. To qualify for a complete refund on a purchase containing promotional products, all items must be returned. Any unreturned promotional products will result in a deduction from the refund amount. Additionally, TekChoice Electronics may present gifts to loyal customers as tokens of appreciation or during special promotions. Product Lifespan: It is important to note that using PC components and systems for cryptocurrency mining can significantly reduce the lifespan of the product due to excessive use. This applies to CPUs, video cards, solid-state, and hard disk drives. Generally, TekChoice Electronics does not accept returns for products that have exceeded their lifespan as a result of overuse.

Deactivate any device connections and take care of any related carrier contracts and fees if your device is under contract.

Guidelines for Returning Items
In order to initiate a return with TekChoice Electronics, you are required to secure an RMA number within the specified return window for the item. This unique RMA number must be clearly marked on the packaging of your return to ensure proper identification. Once you have gathered your items and packaged them securely to prevent any damage during transit, affix the provided return shipping label onto the exterior of the shipping box. Please note that return labels are only valid for a period of 14 days, during which your returned items must reach TekChoice Electronics.
The following conditions are not eligible for return and may result in rejection by TekChoice Electronics:
Products with missing, damaged, altered, or unreadable serial number labels, UPC codes, manufacturer model or part number labels, and warranty labels.
Products returned without original packaging and accessories, including retail box, manuals, cables, and other items initially included.
Products showing physical damage. Damaged products should be reported as a shipping problem for resolution, not as a return.
Products with mail-in rebates submitted.

Return Shipping Labels
At TekChoice Electronics, return shipping labels are provided free of charge for products weighing up to 50lbs. Customers can request a prepaid return label as a courtesy during the return initiation process.
For eligible products being returned for exchange, return shipping labels are also free for replacements of the same item within the designated return policy timeframe. However, customers are responsible for any return shipping costs for items that were originally shipped via large item shipments and remain unopened.
If a product is returned that is either not defective or not the same as the originally purchased item, it will be sent back to the customer. In cases where a refund has already been processed, TekChoice Electronics reserves the right to deduct the return shipping cost from the refund amount.
Trouble with Printing Return Label
If you encounter difficulties printing your return label at home, you can visit a UPS store and request assistance from a UPS representative to print the label using the QR code provided on the return label. To access the QR code, please follow these steps:

Tracking Number
From time to time, you may receive a response stating "tracking number not found". There are various reasons that can lead to this issue:
The shipment notification was sent before the package arrived at the delivery carrier’s terminal for scanning. This is a common cause of tracking errors, and typically resolves itself within a few hours as the scan and tracking progress updates.
The carrier may not have picked up the package on the same day the shipment notification was sent. This timing discrepancy can occur in large distribution centers where packages are being processed at a high volume. Some packages may still be on the conveyor belt when the carrier leaves the facility, leading to delays in tracking updates.
There is a very small likelihood that your package may have experienced a negative event. These occurrences are rare, occurring in less than 0.1% of cases. The potential events include:
Sorting into the wrong trailer: If your package is mistakenly sorted into the wrong trailer, the carrier will return it to our distribution center. During this process, tracking events may not appear for 2-3 days before the package is correctly assigned to the intended carrier.
Label damage: Packages loaded into trailers may rub against each other, potentially causing the label to tear or become dislodged. In such cases, no tracking events will be registered, necessitating the shipment of a replacement order.
